Whole Foods Argues That It Is Their Constitutional Right To Ban Employees From Wearing BLM Masks!

Whole Foods is currently arguing that the federal government is attempting to violate their constitutional rights from blocking their employees from wearing Black Lives Matter masks at work!

According to BET News, the supermarket chain was hit with a complaint from the National Labor Relations Board’s ( NLRB ) accusing them of directly violating federal law within the act of imposing a dress code that blocks support of the BLM organization.

In response, Whole Foods is currently accusing NLRB’s general counsel Jennifer Abruzzo upon claims of attempting to “ compel employer speech”. The Amazon owner brand argues that the alleged act violates their first amendment rights.

Whole Foods has issued a legal filing that reads, “By singling out the phrase ‘Black Lives Matter’ the General Counseling’s is impermissible favoring and requiring that { Whole Foods} favor certain expression of political speech over others in its retail grocery stores.”

In addition they’re arguing that have enforced a dress code, “ to ensure we are giving Team Members a workplace and customers a shopping experience focused entirely on excellent service and high-quality food. We do not believe we should compromise that experience by introducing any messages on uniforms, regardless of the content, that shift the focus away from our mission,” the statement continued.”

Sources confirm that a set of Whole Foods employees filed a discrimination lawsuit back in July 2020 for disciplining workers that wore BLM masks.

The suit also notes that the chain didn’t enforce any form of dress code orders against employees who wore masks or clothing in support of the LGBTQ movement.
