A New York City judge has ruled to dismiss charges of second-degree manslaughter against Daniel Penny for enforcing a chokehold that resulted in the tragic death of Jordan Neely!
According to reports from CNN a Manhattan jury failed to reach an overall verdict in response to the 2023 subway station incident. Sources state the jury of 12 had been “deadlocked twice on three charges.” Ultimately resulting in Daniel’s legal team pushing for a motion to mistrial.
Sources state, that prior to the judge’s ruling the prosecution team agreed to drop the second-degree manslaughter charge if in return the jury could consider the lesser charge of negligent homicide.
As we previously reported Daniel faced one count of manslaughter in the second degree as well as one count of criminally negligent homicide for a deadly chokehold that claimed Jordan’s life.
The 26 year old former marine currently faces a charge of criminally negligent homicide following Jordan’s death, carrying a maximum penalty of four years in prison.
Sources state that the proceeding judge could decide to sentence Daniel to receive no prison time.
It has been indicated that Daniel couldn’t have been convicted of both manslaughter and negligence. Since the more serious charge has been dismissed, the jury has been asked to focus on the remaining criminal charges.
“What that means is you are now free to consider Count 2. Whether that makes any difference or not, I have no idea,”said Judge Wiley.
CNN confirms that the jury of 12 will return on Monday morning December 9th continue deliberations on the remains charge.
