Jussie Smollett ‘s legal team is keeping the ball rolling in hopes of ending his 5 month jail sentencing sooner than later!

According to TMZ, the former Empire star’s attorney alongside his family have filed an emergency motion today requesting a judge to release him from prison while his appeal is pending.

Reports read that Jussie’s team are arguing that jail time for the actor would be more harmful than beneficial. Most recently his family has forwarded claims that they’ve received countless anonymous messages and calls ranging from harassment and threats to homophobic and racial slurs forwarded their way.

A video clip has been issued in which Jussie’s family state show a stranger calling with harmful statements about what should happen to their brother while he’s in jail.

Sources confirm that Jussie’s legal team has also argued within a sworn affidavit from a doctor that the actor at a higher risk of catching COVID due to his reportedly compromised immune system. He also cited positive case rates in jails and prisons across the country.

Jussie’s lawyer also argued that because he’s being held in protective custody could cause him to have a mental outbreak, comparing it to solitary confinement.
